Infringement Notices
Brighton Council can issue infringement notices for non-compliance with regulations and by-laws.
Council is responsible for enforcing a number of Acts of Parliament within the Brighton Council area, including the:-

You must take one of the following actions within 28 days of receiving an infringement notice from Council:
Pay the infringement notice in full by the due date

Request a payment arrangement
Lodge an application to the CEO to enter into a payment arrangement. Please note that requests for payment arrangements will not be accepted unless all sections of the form are completed.

Request the infringement notice be withdrawn
You will need to lodge an application to the CEO to request to withdraw the infringement notice. Please note that investigations will only be conducted if all sections of the request to withdraw form are completed. Please attach any additional information, photographs, or supporting documentation for consideration.

Have the infringement determined by a Court Hearing
Lodge a notice of election for a court hearing within 28 days of the infringement notice being served. Please note that you must complete all sections of the form to elect a court hearing. If you neither request a court hearing nor have the notice withdrawn within 28 days, you will be convicted of the offences listed in the infringement notice, and the fine may be enforced under the Monetary Penalties Enforcement Act 2005.

Completed forms should be returned:-
in person to the Council offices, 1 Tivoli Road, Old Beach;
by post to 1 Tivoli Road, Old Beach Tas 7017; or
via email to admin@brighton.tas.gov.au
Infringements are payable within 28 days of the date of issue.
After 28 days, and before being referred to the Monetary Penalties Enforcement Service (MPES), recovery proceedings will begin, and the amount payable will increase for all offences. Please note that the amount payable may increase if the due date as printed on the front of the infringement notice has expired.
Payments can be made:-
In person: at the Council offices, 1 Tivoli Road, Old Beach between 8.15am to 4.45pm Monday to Friday.
Online: refer to details provided on the infringement notice using BPay/financial institution.
Over the phone: Credit card payments may be made over the phone by calling Council on 6268 7000.
Under the Monetary Penalties Enforcement Act 2005, if a person ignores an infringement notice, they will be deemed convicted, and the penalty will be collected. There will be no court hearing unless the person requests one or Council starts court proceedings.
This Act allows any unpaid infringements issued by the Council to be collected through the State Government’s Monetary Penalty Enforcement Service (MPES).
MPES has a number of options for recovery of non-paid infringements which include:-
– suspension of driver’s licence or car registration until the amount outstanding is paid;
– seizure of goods or deduction from wages to the value of the unpaid infringement.
MPES can also publish the names and addresses of individuals in default of infringement on a web page, which may impact their credit rating.

Deemed Conviction and Enforcement
If you do not pay the infringement notice or request a court hearing within 28 days, and the notice is not withdrawn, you will be convicted of the offence and the penalty may be enforced under the Monetary Penalties Enforcement Act 2005.
After referral to the Director of the Monetary Penalties Enforcement Service, costs for filing and recovery will be payable to MPES, in addition to the unpaid infringement amount.
